ملخص
تتناول هذه الدراسة الآثار المترتبة على التفريق بين الزوجين للعيوب في ضوء قانون الأحوال الشخصية الأردني رقم (36) لسنة 2010م، وحاولت الدراسة أن تعرض الأحكام الموجودة في المواد القانونية مدعمة بالمستندات الفقهية، ومقارنة بالآراء الفقهية، وتتلخص الدراسة ببيان أثر التفريق للعيوب على العدة، والمهر، والنفقة، وعدد الطلقات، والرضاع، والحضانة، والميراث، والوصية، والنسب، والأهلية، وتجديد العقد.
Abstract
The study examined concerned with the separation between spouses for reasons of defects in the light of Jordanian Personal Status Law number (36) for year 2010. It attempted to present the provisions included in the legal articles, supported by jurisprudential documentations and compared to the jurisprudential opinions. Briefly, the study showed the impact of separation for defects on iddah (period of waiting), dowry, alimony, number of divorce verbal acts, breast feeding, custody, inheritance, will, kinship, eligibility and renewal of marriage contract.
