ملخص
يدور هذا البحث حول أثر الاجتهاد المقاصدي على تطبيق النص الشرعي، حيث يبين مفهوم الاجتهاد المقاصدي في تطبيق النص الشرعي وأهميته ومشروعيته والأسس التي يقوم عليها، مع ذكر جملة من الأمثلة التطبيقية على أثر الاجتهاد المقاصدي على تطبيق النص الشرعي، ويبين اتجاهات الفقهاء في المقصد الواجب مراعاته عند تطبيق النص الشرعي، وقد خلص البحث إلى أنه لا بد من تفهم هذا النص الشرعي في ضوء حكمة التشريع، ومقصده، وغايته، ولا بد من تطبيق المنصوص عليه في الواقع على الوجه الذي يحقق تلك الغاية.
Abstract
This research deals with the impact of Ijtihad al-Maqasdi in the application of the legal text, which shows its concept and importance, its legitimacy and the bases upon which it is based, with a number of practical examples on the effect of ijtihad al-Maqasdi in the application of the legal text and the directions of fuqaha ' The research concluded that this legal text must be understood in the light of the wisdom of the legislation, its purpose and purpose, and it must be applied in practice in the manner that achieves the purpose.
