الملخص
الحق في النسب هو أحد الحقوق الأساسية للطفل، بحيث أن التلاعب بنسب الطفل ونسبته للغير يترتب عليه إهدار للكثير من حقوق الطفل الشخصية والأسرية والمالية، لذلك جاءت هذه الدراسة لمعالجة إشكالية الاعتداء على نسب الطفل وتحديداً نسب الطفل للغير، وبيان جوانب الحماية الجزائية لهذا الحق، من خلال عرض موقف القانون الجزائي في الأردن من واقعة نسب الطفل للغير، وبيان الأركان المؤلفة لهذه الجريمة، وتسليط الضوء على موقف المشرع الجزائي من تقنية تأجير الأرحام، مع الإشارة إلى موقف بعض التشريعات الجزائية المقارنة.
بحيث خلصت الدراسة إلى مجموعة من النتائج أهمها، أن المشرع الأردني اعتنى بحق الطفل للنسب من خلال تجريمه لشكل منفرد من أشكـال الاعتداء على النسب وهو نسب الطفل للغير، وجاءت هذه الجريمة مقيدة من حيث أنماط السلوك الواجب توافرها لقيام الركن المادي، كما أن المشرع لم يجرم ولم يعترف بتقنية تأجير الأرحام في معرض تجريمه لنسب الطفل للغير.
Abstract
The child’s kinship is one of the fundamental rights of the child. The manipulation in this matter of the pedigree to others causes a major waste to the child’s personal، family، and financial rights. Therefore، this study tends to deal with kinship’s forms of assaults particularly the custody to others.
It also states the panel protection to such right through illustrating the Jordanian panel law to show the criminal status to this crime. It also sheds light on the legislator panel code as well as other legislations regarding surrogacy.
The study has concluded many results. The Jordanian legislator paid a great attention to the child’s kinship and considered the situation criminal in case of any violation specially pedigree the child to others. This crime is restricted to the behavioristic patterns that must be fulfilled to create the materialistic elements of the case.
The legislator has also recognized surrogacy as a crime while criminalizing the change of kinship to others.
