Abstract

ملخص تتناول هذه الدراسة ضوابط المسائل المخالفة لما اتفقت عليه المذاهب الأربعة دراسة تطبيقية، وبيان مدى الاختلاف في الأحكام الشرعية, فقد تبين أن بعض الأحكام اختلف الفقهاء بها، وهذه المسائل بحاجة إلى مزيد من البحث وجمع الآراء من المذاهب المختلفة وبيان مدى توافقها مع مجامع الفقه الإسلامي، وجاءت الدراسة؛ للجمع بين الآراء المختلفة وبيان الراجح منها، وجاءت الدراسة؛ لتؤكد القول بالمنع في المسائل التي تنظم أمور المجتمع المسلم، كتولي المرأة رئاسة الدولة, ومساواتها بالرجل في الميراث, ومساواة الذمي بالمسلم في مقدار الدية, والتي أباحها بعض الباحثين استنادا إلى حجج قاصرة عن الحكم. Abstract The study deals with the rooting of dealing with the sects in Islamic jurisprudence as an applied study, and showing the importance of giving the shar'i rulings the peremptory character. It has been found that the rulings that have been proven are not changed with the changing times and conditions and with the evolution of the times. These issues need further research and rooting in Islamic jurisprudence, And the study confirms the prevention of the issues that govern the affairs of the Muslim community, such as the succession of women to the presidency of the state, and equality of men in inheritance, and equality of the Muslim in the amount of fat, which allowed some researchers on the basis of arguments short of governance.
