تطبيقات على الاحتجاج بقياس الشبه في المذهب الشافعي

Abstract

ملخص تُعرَّف هذه الدراسة بقياس الشبه، وتشير إلى أن غالبية علماء أصول الفقه من مختلف المذاهب الإسلامية احتجوا به، وتبيّن أن الشافعية اعتمدوا على قياس الشبه في الحكم على كثير من المسائل الفقهية، وذكرت الدراسة نماذج منها في العبادات، والمعاملات والمناكحات، والجنايات، والأيمان، والنذور. Abstract This study is identified with deduction by analogy. The majority of legal knowledge scientists from different Islamic sectors have taken it as a foundation.Shafaee relayed on deduction analogy in giving jugements in many legal knowledge questions.The study mentioned examples of worships, marriages, crimes, oaths and vaws
