حَاوَلَ البَحْثُ الإِجَابَةَ عَلَى سُؤَالَينِ أَسَاسِيَّينِ: هَل هُنَاكَ إِعجَازٌ تَشرِيعِيٌّ إِسلَامِيٌّ يتَعَلَّقُ بِحَقِّ امتِيَازِ البَائِعِ عَلَى المَبِيعِ؟ وَكَيفَ أَثَّرَ ذَلِكَ فِي اهتِدَاءِ القَوَانِينِ الوَضعِيَّةِ لِهَذَا الحَقِّ، وَلِحُقُوقِ الامتِيَازِ الأُخرَى؟ وَاتَّبَعَ البَحْثُ مَنْهَجَاً اسْتِقْرَائِيَّاً تَحْلِيلِيَّاً، بِتَتَبُّعِ النُّصُوصِ التَّشرِيعِيَّةَ وَكَلَامَ الفُقَهَاءِ وَالقَانُونِيِّينَ، مَعَ التَّحْلِيلِ. وَقُسِّمَ البَحْثُ إِلَى سِتَّةِ مَطَالِبَ: تَنَاوَلَت امتِيَازَ البَائِعِ عَلَى المَبِيعِ. وَالحَدِيثَ النَّبَوِيَّ الذِي قَرَّرَهُ، وَالإعجَازَ التَّشرِيعِيَّ فِي ذَلِكَ، وَأَثَرَ ذَلِكَ فِي القَانُونِ الفَرَنسِيِّ وَالقَوَانِينِ الوَضعِيَّةِ. وَخَلَصَ البَحْثُ إِلَى نَتَائِجَ، أَهَمُّهَا: يُمَثِّلُ تَقرِيرُ حَدِيثٍ نَبَوِيٍّ لامتِيَازَ البَائِعِ عَلَى المَبِيعِ -قَبلَ مَا يَزَيدُ عَلَى أربَعَةَ عَشَرَ قَرنَاً- إِعجَازَاً تَشرِيعِيَّاً، وَنَتَجَ عَنهُ مَعرِفَةُ فُقَهَائِنَا السَّابِقِينَ لِحُقُوقِ الامتِيَازِ الخَاصَّةِ، وَاقتِبَاسِ المُشَرِّعِ الفَرَنسِيِّ وَالقَوَانِينِ الوَضعِيَّةِ ذَلِكَ عَنهُم.
Abstract
This research aims to answer two main questions: Is there a legislative Islamic miracle regarding the right of "seller's privilege on sales"? And how did that cause the civil laws to recognize this right and other privilege rights? The research followed inductive and analytic approach, through tracking legislative texts and the statements of jurists in both Islamic legislation and civil laws, accompanied with the analysis. The search was divided into six sections dealing with: The Seller’s privilege on sales. The prophet statement that proposed this right, the legislative miracle in that, and the impact of this on the French civil law and other civil laws. The researcher arrived at different findings, the prophet statement that proposed this right –before more than fourteen centuries– represents a legislative miracle, which resulted in the knowledge of our former jurists in Islamic legislation of the rights of private privilege, and later the quotation of that knowledge by French legislator and other civil laws.
