ملخص
تناولنا في هذا البحث (الرأي الفقهي والقانوني لاستئصال رحم الفتاة المعاقة عقليا). حيث عرّفنا مفهوم الإعاقة وبينّا التطور التاريخي للنظرة للمعاق، واهتمام الشريعة بالمعاق ثم تحدثنا عن أسباب الإعاقة وأنواعها، وتبين لنا أن الإعاقة ليست بدرجة واحدة، ثم بحثنا الرأي الفقهي لهذا الموضوع وحرص الشريعة الإسلامية على حقوق المعاق وتحريمها الاعتداء على كرامته وحقوقه، واعتبرت استئصال الرحم لدى الفتاة المعاقة جريمة يُعاقب عليها، واتفق حكم فقهاء القانون الدولي مع ذلك من خلال تشّريع الكثير من الاتفاقيات الدولية للحفاظ على حقوق هذه الفئة من المجتمع، كما اعتبر القانون التمييز بين المواطنين جريمة يُعاقب عليها، كما تناولت الرأي الطبي لهذا الموضوع الذي اعتبر إجراء مثل هذه العمليات اعتداء على إنسانية الإنسان مع وجود رأي آخر للأطباء والذي كان يسمح بها ضمن المعطيات التي يرى أنها في مصلحة المعاقة فدار الحوار بين فريقين: فريق يرى تحريم إجراء هذه العمليات، وفريق يؤيد إجراء هذه العمليات بوصفها مصلحة للمعاقة، وتناولت الدراسة في بعض مراحلها التشريع الأردني بوصفه من الموضوعات التي طرحت على الساحة الأردنية.
Abstract
We dealt in this research with (Opinion jurisprudential and legal framework for hysterectomy her mentally disabled). Where we discussed the meaning of disability and the historical development of the look of the disabled Islam is concerned with welfare of disabled persons and then we talked about the causes of disability and type of and show us that disability is not one degree, and then looked juristic opinion to this subject, and make sure the Islamic law on the rights of the disabled and interdiction assault on the dignity and rights and was considered a girl's hysterectomy disabled a punishable offense, and it was agreed the rule of international law scholars with through the legislation of many international conventions to preserve the rights of this category of society, and considered the law to discriminate between citizens a punishable offense, also addressed the medical opinion of this.
