Abstract: ملخص قاعدة التأسيس أولى من التأكيد من القواعد الأصولية الفقهية المتفق عليها بين الأصوليين والفقهاء والمفسرين والمحدثين وتعني: أن اللفظ إذا دار بين أن يفيد معنى جديداً وهو التأسيس، وبين أن يؤكد معنى سابقاً، فحمله على التأسيس أولى وأوجب من حمله على التأكيد. وهي من القواعد المتفرعة عن قاعدة " أعمال الكلام أولى من إهماله" وهي قاعدة مهمة في تفسير نصوص الشارع وفهم مقاصده، فهي تتعلق بالدرجة الأولى بخطابات الشارع الحكيم وتصون كلامه عن الإلغاء والإهمال. وهي أيضاً قاعدة مهمة لفهم الكلام الصادر عن المكلف وصونه عن الإلغاء والإهمال لما يترتب على ذلك من أثر كبير في الحكم على تصرفاته. وكما يظهر من صيغة القاعدة فهي قاعدة ترجيحية، فكما استخدمها الأصوليون والفقهاء والمفسرون والمحدثون كدليل على ما ذهبوا إليه إبتداءً، استخدموها لترجيح قول على آخر. وقد تناولت هذه الدراسة هذه القاعدة بالتحليل فشرحتها وبينت معناها الإجمالي، والصيغ التي وردت بها، وبينت أيضا أثر هذه القاعدة وتطبيقاتها عند الأصوليين والفقهاء والمفسرين والمحدثين. Abstract This Rule is one of the fundamental jurisprudence which agreed among most of the scholars of figh , Tafsier, and Hadith. This rule means that of a word used in many ways, this indict that there is a new meaning of this which means the establishment Rule are more priority than emphasis. The rule is branch from the main rule "implement the words more priority than neglecting it". This is an important base for the interpretation of shariah text, and to understand the speech of the adult, and to balance between opinions. In conclusion the researcher shows the effect of this rule and its implementations according to scholars
