ملخص

يهدف هذا البحث إلى تسليط الضوء على معاملة الأسرى في ضوء الشريعة الإسلامية والقانون الدولي الإنساني؛ ذلك أن الشريعة الإسلامية هي المصدر الرئيسي للتشريع لدى كتلة كبيرة من الدول يتجاوز عددها الآن الأربعين دولة وقد ظلت هذه الدول محكومة بقواعد تلك الشريعة حتى وقت قريب؛ لذا تعد هذه الشريعة المصدر الرئيسي الموضوعي والتاريخي لتشريعات تلك الدول. ومن هنا يقبل المجتمع الدولي هذه الشريعة كواحدة من الأنظمة القانونية الرئيسية في العالم؛ وليس ثمة من شك في أن كثيرا من المبادئ والقواعد القانونية الإسلامية قد أسهمت في إرساء قواعد القانون الدولي الإنساني الذي استمد قواعده من العقائد والأديان والفلسفات المختلفة ومن بينها الشريعة الإسلامية بمبادئها السامية والخلاقة. وسوف تقتصر هذه الدراسة على جانب واحد من الجوانب الإنسانية في وقت الحرب هو معاملة أسرى الحرب كدراسة مقارنة بين الشريعة الإسلامية والقانون الدولي الإنساني. Abstract In this study we shed the light on the treatment of prisoners of war in View of Islamic Law and Humanitarian International Law , Islamic Law is the main source of a larg number of states exceeding forty states. Those states were governed and ruled by the rules of that law. up to shorter time , For this reason this law is considered the main Objective and historical source of the legislations of those states. Consequently , International Society accepts this law as one of the main legal regimes in the world, represented in the formation of international court of justice according to article 38 of the statute of the court. No doubt that a large number of principles and Islamic. legal rules participated in establishing the rules of humanitarian international law which extracted its rules from different beliefs, religions and philosophies including Islamic law with its creative principles.
