ملخص
تعارف الناس على بعض الألفاظ المشتركة بشأن صور الزواج، كلفظ زواج المسيار، وزواج السفر، والزواج العرفي والزواج المدني وغيرها، وكان لهذه الصور أثر في استقرار الزواج، فكانت هذه الدراسة لمعرفة الأحكام الشرعية لهذه الألفاظ؛ ولبيان أثرها في استقرار الأسرة، وفي مدى تحقيقها لأهداف الزواج ومقاصده.
وخلصت الدراسة إلى القول بأن تحقيق الاستقرار الأسري من أهم مقاصد الزواج، وأن زواج السفر، زواج المسيار يعتبران مشروعان متى توافرت لهما الأركان والشروط، ولم يعبر أحد المتعاقدين عن مخالفة مقاصد العقد هذا في القول المختار. والزواج المدني، والزواج العرفي، وزواج المثليين، وزواج الأصدقاء تعتبر صوراً غير مشروعة للاختلال في الأصل أو الوصف ولتناقضهما مع مقاصد عقد الزواج ومآلاته التي من أهمها تحقيق السكن والاستقرار.
Abstract
Dating people some common words on pictures marriage, Klfez temporary marriage, and the marriage of travel, marriage customary and civil marriages, etc., and it was these images impact on the stability of marriage, this study was to know the legal provisions of these terms; and to indicate their impact on the stability of the family, and how to achieve goals marriage and its purposes.
