آثار الخطأ في الفتوى في الشريعة الإسلامية

Abstract

ملخص موضوع الفتوى من الموضوعات المهمة في كل زمان. وفي هذه الأيام تصدى للفتوى بعض من هم ليسوا بأهل لها حتى أفتوا في قضايا دقيقة وحساسة تتعلق بمصير الأمة الإسلامية مما تسبب في إتهام الدين الإسلامي بالتشدد والتطرف والإرهاب. ونظراً لأهمية الفتوى تناول هذا البحث أثر الخطأ في الفتوى على كل من المفتي، والفتوى، والمستفتي، والحاكم. وتطرق البحث أيضاً إلى واجب الحاكم في تولية من يصلح لمنصب الإفتاء وتفقد أحوال المفتين، واتخاذ التدابير والعقوبات التعزيرية بحق من اعتاد الخطأ واشتهر عنه ذلك. الكلمات الدالة: الفتوى، المفتي، المستفتي، الأثر، الخطأ. Abstract The issue of Fatwa is an important issue in all times. Nowadays many unqualified persons started to say Fatwa and they gave Fatwa in critical issues that are related to the fate of the Islamic nation which led to accusing Islam of terrorism and extremism. Due to Fatwa Importance, this research studied the impact of fatwa mistakes. The research studies the consequences of Fatwa mistakes on Mufti, the Fatwa, the person asking for Fatwa and the ruler. The research also studied the responsibility of ruler in employing the qualified people for Fatwa and following the Muftis and taking measures and discretionary punishments against those who repeatedly made mistakes and were know of that.
