Title: التصوير الآلي وأثره في إثبات الحدود: دراسة فقهية

Abstract: الملخص تهدف هذه الدراسة إلى بيان حكم الشريعة الإسلامية في موضوع إثبات الحدود بالتصوير الآلي، فالتصوير الآلي من الوسائل ‏العلمية الحديثة التي يمكن الاعتماد عليها في مجال الإثبات، ولكن هل يصلح أن يكون دليلا مستقلا لإثبات الحدود، لذلك جاءت ‏هذه الدراسة لتبين حجية التصوير الآلي في إثبات الحدود، وقد تناولت الدراسة تعريف التصوير في اللغة والاصطلاح، وكذلك ‏أنواع التصوير الآلي، ثم بينت تعريف الحدود في اللغة والاصطلاح، وأنواع الحدود، ثم بينت حكم الشريعة الإسلامية في الاعتماد ‏على التصوير الآلي، كما تناولت الدراسة حكم التجسس باستخدام التصوير الآلي، وحكم الاعتماد على القرائن في إثبات الحدود، ‏وقد خلصت الدراسة إلى أنه لا يجوز الاعتماد على التصوير الآلي في إثبات الحدود، ولكن يمكن الاستفادة منه باعتباره قرينة غير ‏قطعية في إثبات الحدود، وكذلك يمكن الاستفادة من التصوير الآلي في إثبات الجرائم التي تستوجب عقوبة تعزيرية، كما خلصت ‏الدراسة إلى أن الحدود لا تثبت بالقرائن.‏ Abstract ‏ ‏ The aim of this study is to show the verdicts of Islamic doctrine concerning Major violations (Ḥudūds) in automated ‎imaging. Automated imaging is considered as a modern means that can be relied upon to prove violations. The ‎question that this paper sought to answer whether it fits to be considered as an evidence to prove these major ‎violations (Ḥudūds) from the Islamic point of view. Therefore, this study dealt with the definition of automated ‎imaging lingually and conceptually, the types of automated imaging, the definition of these major violations (Ḥudūds) ‎lingually and conceptually, and these violations types. Then, this study showed the verdict of Islamic doctrine based ‎on the automated imaging; it also dealt with the punishment of spying in using automated imaging as well as the ‎conception of relying upon resumption of law in proving these violations. The study concluded that relying upon the ‎automated imaging as a main piece of evidence in proving the violation is not sufficient; automated imaging can be ‎useful as a non-final presumption of law in proving the violation and also it can be useful in proving the crimes that ‎required an offending (Tazir) punishment
