الأحكام الإجرائية الخاصة بمحافحة التعذيب في التشريع الأردني.

Abstract

الملخص التعذيب وغيره من ضروب المعاملة اللاإنسانية نهت عنه الاتفاقيات الدولية الخاصة بحقوق الإنسان, وجرمته القوانين ‏الجزائية الوطنية, إلا أن المواجهة الحقيقة لهذا النوع من الإجرام لا يقتصر على تجريمه بنصوص جزائية, ما لم تحاط هذه ‏النصوص بضمانات إجرائية تهدف إلى ضمان عدم إفلات الجناة من العقاب.‏ جاءت هذه الدراسة للوقوف على المبادئ القانونية الضامنة لعدم إفلات مرتكبي التعذيب من الملاحقة, وبيان الإجراءات ‏القانونية الكفيلة بكشف هذا النوع من الجرائم, والتحري عن مرتكبيها وضمان تقديمهم إلى العدالة, ومن ثم عالجت الدراسة حجية ‏الدليل المستمد من التعذيب ومدى قبوله أمام القضاء الجزائي, واخيراً خلصت الدراسة إلى مجموعة من النتائج والتوصيات.‏

Abstract Torture and other inhuman cruelties were discouraged by the international conventions of human rights, and ‎had been condemned by national criminal laws, but the confrontation truth to this type of crime is not limited to ‎criminalizing by criminal texts, unless surrounded by these texts procedural guarantees designed to ensure the ‎impunity of the perpetrators‏. ‏ This study aimed at determining the legal principles guaranteeing not to impunity for the perpetrators of ‎torture from prosecution, and the statement of the legal procedures to ensure disclosure of this type of crime, and the ‎investigation of the perpetrators and ensuring bringing them to justice, and then it dealt with the study authoritative ‎evidence derived from torture and its acceptability in front of the criminal justice system, and finally the study ‎concluded a set of findings and recommendations.‎
