الملخص
تهدف هذه الدراسة لتسليط الضوء على مسألة "إحداث القول الجديد" أو ما اشتهر عند الأصوليين بتسميته "إحداث القول الثالث"، مع بيان المصطلحات الأخرى المرتبطة بالمسألة، والخلاف الأصولي فيها، وبيان الاضطراب في نسبة الأقوال الأصولية فيها، وأدلة كل فريق لما ذهب إليه ومناقشتها، خاصة مع أهمية أثر هذه المسألة على الخلاف الفروعي الفقهي، وتخريج الفروع على الأصول.
وتكشف الدراسة أيضاً عن آراء بعض المعاصرين من فقهاء المسلمين المتأخرين والحداثيين في هذه المسألة، وأثر ذلك في آرائهم في المسائل الفقهية لاسيما مع كثرة الآراء في الزمن الحاضر التي يحكم عليها بناءً على الفقه المذهبي بأن فيها إحداثاً لقول جديد.
Abstract
This study aims at shedding the light on the question of "the creation of new say", or what the fundamentalist would call the creation of a third say in fundamentalisms, discussing the fundamental disputes, and showing the difficulties of the relative says among the fundamentalists, indicating the opinions and proofs presented by each group. The study discusses these differences, in particular the effect of these disputes on the branches of fundamentalisms, and vice versa, the impact of the branches on the fundamentals due to these differences. The study also indicates the opinions of some of the late and contemporary Sharia's Muslims jurists, and the Modernity, and the effects of these opinions, abundant nowadays, and creating yet further new says, on the question of this study, as judged by the standards of fundamentalisms. In addition, the study indicates the terminologies associated with this question of the third say.
