الملخص
تناول هذا البحث دراسة موضوع: نظرية الظروف الطارئة: أركانها وشروطها، وقد جعله الباحث في تمهيد وثلاثة مباحث، عرض في التمهيد تعريف الركن والشرط والفرق بينهما، وتعريف الظروف الطارئة. وعرض في المبحث الأول الركن الأول وهو العقد، ذكر فيه الشروط التي يجب توفرها في العقد حتى يمكن تطبيق نظرية الظروف الطارئة عليه. أما في المبحث الثاني فعرض الباحث فيه الركن الثاني وهو الظرف الطارئ، ذكر فيه أقسام الظروف الطارئة وشروطها. أما في المبحث الثالث فعرض الباحث الجزاء في نظرية الظروف الطارئة، في الفقه الإسلامي والقانون الوضعي، سواء كان برد الالتزام المرهق إلى الحد المعقول، أو بفسخ العقد. ثم انتهى الباحث بخاتمة جمع فيها أهم النقاط التي تطرق إليها الباحث في بحثه.
Abstract
This research involves the topic: ?The Unexpected Situations Theory: Its basis and conditions?. The research is divided into an introduction and three subjects. The introduction contains the definition of the base, the conditions and the differences between them, and the definition of the unexpected situations. The second subject contains the first base, ?the contract?, and the conditions that must exist to apply the unexpected situations theory. The third subject contains the penalty in the unexpected situations theory, in the Islamic law, and in the positive law, either to return the exhausting commitment to the reasonable limit, or to revoke the contract. Finally, the researcher ended his research with a conclusion containing the main points that was discussed in the research
