"حديث الأوزاعـي في المســح على العمامة عند البخـاري " دراســـة نقديــة

Abstract

الملخص قمنا في هذا البحث بدراسة الانتقاد الموجه لحديث الأوزاعيّ في المسح على العمامة، والذي أخرجه البخاريّ في باب المسح على الخفّين، وذكر أن معمراً تابعه، إلا أنّ ابن قتيبة وبعض علماء المالكيّة تكلّموا فيه وردّوه، بحجج متفاوتة، زعم ابن قتيبة أنه منسوخ بالإجماع، وقال بعض علماء المالكيّة أنّه مما انفرد به الأوزاعيّ مخالفا للثقات، وبالغ بعضهم فحكم باضطرابه، فقمنا بتخريج الحديث، وذكرنا من عمل به من فقهاء الصحابة خاصّة، ودرسنا طبقات الرّواة على يحيى بن أبي كثير مدار الرّواية، وأثبتنا بأقوال النّقاد أنّ الأوزاعيّ هو المقدّم بينهم في الرّواية عن يحيى، مما يقتضي تقديم روايته وقبولها، خاصّة أنّ زيادة المسح على الخفّين ليست منافية للحديث الواردة فيه، كما أنّها ثبّتت من طريق صحابي آخر. الكلمات الدالة: صحيح البخاري، الأحاديث المنتقدة، الدفاع عن صحيح البخاري، حديث العمامة. Abstract The current study examined the critique addressed to Al Awzaiey saying concerning rubbing the turban, which was classified by Al Bukari in the entry of rubbing slippers. He mentioned that Mumaar tracked it, but Ibn Qutaibah and other Maleki scholars spoke about it and was refuted by them employing various arguments such as it is cloned by consensus. Some Maleki scholars said that what Al Awzaiey was unique about is in disagreement with the trusted Hadeeth scholars and some of them exaggerated saying it was distorted and this the reason why the current study classified this Hadeeth. In doing so, the study cited some of the companions work concerning this saying. We also examined the strata of narrators reaching to Yehya Bin Abi Katheer, the narrator of this saying. We proved by the sayings of critiques that Al Awzaiey was the favored in narration about Yehya, meaning that his narration is favorable and should be accepted, especially when knowing that increasing rubbing slippers does not contradict the saying mentioned in this Hadeeth as it was proven from another companion.
