تطبيقات التوثيق بالإشهاد على بعض مسائل الأحوال الشخصية: دراسة مقارنة بالقانون العُمانـي

الملخص

جاء هذا البحث ليبين نوعا من أنواع التوثيق وهو التوثيق بالإشهاد، ذلك الأمر الذي حث المولى عز وجل عليه في كتابه ‏العزيز، وكذا نبيه الكريم صلوات الله وسلامه عليه في سنته المطهرة، ذلك الأمر الذي غلب على ظن كثير من الناس أنه داخل في ‏موضوع الشهادة ويشترط له ما يشترط للشهادة، وأحكامه هي أحكام الشهادة ذاتها، فجاء هذا البحث ليجلي حقيقة التوثيق بالإشهاد ‏من حيث مفهومه، وحكمه، وحكمته، وأدلة مشروعيته، والفرق بينه وبين الشهادة، ثم بيان بعض التطبيقات الفقهية والقانونية له - ‏القانون العماني- في مسائل من الأحوال الشخصية، كالتوثيق بالإشهاد على الرجعة، والتوثيق بالإشهاد على دفع المال إلى الأيتام ‏بعد رشدهم، وكذا التوثيق بالإشهاد على الوصية، ثم بيان أهم النتائج التي توصل إليها الباحثان وتوصياتهم.‏ الكلمات المفتاحية: التوثيق، الشهادة، الأحوال الشخصية.‏

Abstract

The research has to show some kind of documentation Its Documentation Through Witness So which urged ‎the Almighty God in his holy book, as well as the Holy Prophet of God and prayers be upon him in the Sunnah So ‎which dominated the thought that many people inside the subject of the testimony of witnesses and requiring him ‎what is required for the testimony of a witness and the provisions are the same provisions of the witnesses testimony ‎‎.‎ This research was to demonstrate the fact that the Documentation Through Witness In terms of meaning and ‎judgment and wisdom and evidence of legitimacy and the difference between him and the testimony of witnesses .‎ Then clarify some jurisprudential and legal applications him – Omani law- in matters of personal status ‎Example documentation testimony of witnesses recourse and authentication testimony of witnesses to pay money to ‎the orphans after their senses and such documentation testimony of witnesses the commandment, then among the ‎most important findings of the researchers and their recommendations.‎ Keywords: ‎‏ ‏Testimony, Testimony, Personal status.‎
