دستورية شروط عضوية مجلس النواب الأردني، ومدى تأثيرهذه العضوية بالأحكام الجزائية: دراسة تحليلية

Abstract

الملخص تتحدث هذه الدراسة عن مـدى دستورية شروط العضوية لدى مجلس النواب الأردني‎ ‎وفق ما ورد في قانون الانتخاب ‏لمجلس النواب رقم (6) لسنة (2016م)، مع بيان مفصل لكل ما تضمنته هذه الشروط من جزئيات خالفت الدستور, وقد اظهرت ‏الدراسة العديد من الشبهات الدستورية كانت قد اعترت قانون الانتخاب الأردني, مع الإشارة إلى الآثار المترتبة على إدانة أحد ‏النواب بجرم غير سياسي عقوبته عن الحبس سنة واحدة, مع تقديم الأمثلة العملية من ساحات القضاء الأردني.‏ ‏(الكلمات الدالة): قانون الانتخاب الأردني, مدى دستورية قانون الانتخاب, شروط النائب الأردني, مدى دستورية شروط العضوية ‏في مجلس النواب, أثر الأحكام الجزائية على النائب.‏

Abstract

This study talks about the constitutionality of the conditions for membership in the Council of ‎Representatives, according to what is stated in the Jordanian election law No. (6) of 2016, the study shows the ‎constitutional violations are all in this law, the study showed the effects of a conviction on the members of the House ‎of Representatives in the non-political crimes and that his sentence than the for one year, the study shows practical ‎examples presented to the Jordanian judiciary‏. ‏ Keywords: Jordan's electoral law, the constitutionality of the electoral law, the terms of the Jordanian MP, the ‎constitutionality of the conditions for membership in the House of Representatives, following the penal provisions ‎on the MP‏.‏
