مدى فعالية آليات الأمم المتحدة لحماية حقوق الإنسان

Abstract

الملخص تناول البحث موضوع مدى فعالية آليات الأمم المتحدة لحماية حقوق الإنسان, وقد عرضنا ‏آلياتها المنبثقة عن ميثاقها, وآلياتها التعاقدية الناتجة عن المعاهدات الدولية التي تبنتها. وتطرقنا إلى ‏الصعوبات التي تعيقها في وضع هذه الآليات محل التنفيذ مع بيان جهودها للتقليل من تلك المعيقات. ‏وتم التوصل إلى أن الأمم المتحدة تتحمل مسؤولية رئيسية في حماية حقوق الإنسان, ولكن يقع على ‏الدول بالدرجة الأولى مسؤولية اتخاذ التدابير المناسبة لضمان تمتع مواطنيها بحقوقهم من خلال ‏تشريعاتها وتعاونها مع اللجان؛ لأن هذه الحماية لم تظهر بعد في إطار قانوني مدعم بآليات تنفيذ كما ‏هو الحال في النظام الأوروبي.‏ الكلمات الدالة: معاهدات حقوق الإنسان، لجان حقوق الإنسان، مجلس حقوق الإنسان، ‏المفوضية السامية لحقوق الإنسان، المحكمة الأوروبية لحقوق الإنسان.‏

Abstract The research tackled the availability of effectiveness of the United Nations ‎‏)‏UN‏(‏‎ ‎mechanisms to protect Human Rights ‎‏)‏HR‏(‏‎, we presented its mechanisms emerged from ‎its charter‏ ‏and its contractual mechanisms resulted from the international treaties. ‎Furthermore, we discussed the difficulties which constrain it ‎‏)‏UN‏(‏‎ to put these ‎mechanisms into operation, with clarifying to its efforts to decrease those obstacles. It is ‎reached to that UN tolerate the main responsibility to protect HR. But, basically, the ‎countries should have the responsibility of making suitable arrangements to ensure the ‎citizens having their rights through their legislations and their cooperation with ‎committees, because this protection till now doesen‏’‏t appear in legal frame supported by ‎enforcement mechanisms as in the European system‏.‏
