ملخص
تهدف هذه الدراسة إلى بيان أثر الفقه الإسلامي في القانون المدني باعتباره القانون العام بالنسبة إلى غيره من القوانين الخاصة المتعلقة بالجوانب المدنية، وهو القانون الذي اعتمدت عليه كثير من التشريعات العربية في صياغة قوانينها المدنية، بينت الدراسة أن الفقه الإسلامي كان له أثر كبير في صياغته التشريعية، وفي الاعتماد عليه في تقرير القواعد القانونية، كما أنه أثر كثيراً في تحديد المصادر التي يستند إليها القاضي في قضائه، كما أنه استقى عدداً كبيراً من نظرياته وقواعده الفقهية من التراث الفقهي، فضلاً عن أنه اعتبر أصول الفقه الإسلامي هو المرجع في فهم النص وتفسيره وتأويله.
Abstract
This study aims to demonstrate the impact of Islamic jurisprudence in civil law as a general law for the other laws on the Civil Aspects, a law which was adopted by many Arab legislations in the drafting of civil laws, the study showed that Islamic jurisprudence has had a significant impact on the formulation legislative in relied upon in the report of the legal rules, as it is often impact in determining the sources on which the judge, in his administration, and it drew a large number of theories and rules of jurisprudence from the legacy of jurisprudence, as well as he considered the assets of Islamic jurisprudence is the reference in the understanding of the text and interpreted and construed.
