ملخص
تهدف هذه الدراسة إلى بيان أثر ثبات مقاصد الشريعة في تغيير بيان مدلول خطاب الشارع من خلال بيان أهمية فهم خصائص مقاصد الشريعة وتسخير هذا الفهم في عملية الاجتهاد الفقهي بجعله ضابطا للفتوى واستنباط أحكام النوازل من النصوص الشرعية، وذلك بتغيير مدلول خطاب الشارع إذا ترتب على العمل به فوات واحدة من الكليات الخمسة التي حرص الشرع على حفظها، فمنهج الشارع في حماية الكليات الخمس ثابت لا يتغير وإن تغير مدلول بعض خطاباته العملية، وقد ركز الباحث في هذه الدراسة على بيان خصائص مقاصد الشريعة الخاصة والعامة، معتمدا في ذلك على المنهج الاستقرائي والمنهج التحليلي.
وكان من أبرز نتائج هذه الدراسة أن المقصود بثبات مقاصد الشريعة "دوام واستقرار المعاني والحِكَم التي راعاها الشارع في تشريعه للأحكام"، كما أن لمقاصد الشريعة خصائص خاصة انفردت بها عن غيرها هي الثبات والمعيارية والتطبيق، وهي ضوابط لفهم مدلول خطاب الشارع، وسبب في بيان تغييره من الجواز إلى المنع، والعكس، فهي دليل يخصص به العام ويقيد به المطلق ويرجح به أحد مجازات الخاص فيحمل عليه.

Abstract
This study aims to demonstrate the impact of the stability of the purposes shariah at changing of meaning demonstration of the legislator speech within a clarify the importance of understanding of the purposes shariah characteristics and harness this understanding in the jurisprudence process by making it a criterion of the fatwa and drawing out of the provisions development of religious texts, thats by changing of meaning demonstration of thr legislator speech if the working on it caused, bassing one of the five colleges witch observe law to keeping it, that the concept of the legislator in keeping them is lasting and not fixing. The researcher has focused in this study, at understanding of the purposes of the puplic and private law characteristics , he depended on the inductive method and analytical approach.
One of the most important results of this study that for the purposes of law characteristics conform them with the properties the shariah and its provisions, Also, for purposes of Shariah private properties: stability, and normative, and able to be applicated. which controls the understanding the meanings of legislator speech, and the reason on the clairyfy of change from permissible to prevention (or conversely), its an evidence to privated the puplice, and restricts the absolute.
