Abstract

ملخص يتناول هذا البحث مسألة مهمة؛ ألا وهي مراعاة الشارع الحكيم الجانب النفسي للملكلفين في الأحكام الشرعية المختلفة، خاصة وإنّ الشائع الغالب؛ الحديث عن مراعاة الشارع الحكيم الجانب العقلي للمكلفين في الأحكام الشرعية. ولذا تناول هذا البحث في أول مباحثه معنى الجانب النفسي ومعنى الحكم، ثم تناول في مبحثه الثاني الأدلة من الكتاب والسنة على مراعاة الشارع الحكيم للجانب النفسي لدى المكلفين، ثم تناول في مبحثه الثالث أهمية مراعاة الشارع الحكيم للجانب النفسي للمكلفين والآثار المترتبة على ذلك، ثم تناول في آخر مباحثه أمثلة على مراعاة الجانب النفسي في الأحكام الشرعية، العقدية والعملية والأخلاقية، ثم خلص إلى أبرز النتائج. Abstract This research speaks about an important topic is the owner of Sharia into account the psychological aspect of the Qualified people in the various legal provisions; Especially since the common often talk about taking into account the mental side of the Qualified people in the legal provisions, in order that this research occur in the first discussing the meaning of the psychological aspect and the meaning of rule; Then it spoke in the second section of evidence from the Qur'an and Sunnah to observe the legislator psychological side with the Qualified people, then he spoke in the third section of the importance of taking into account the legislator assigned by the psychological implications of it then discussing it in another display examples of the psychological aspect into account the legal provisions in the contractual and practical and moral, then concluded the most important results.
