الملخص
للعرف دور مهم في ميادين الحياة العامة، وبخاصة في الأمور المالية، ويعتبر من أهم الوسائل والأدوات التي يستعان بها في رفع الخلاف والنزاع بين الناس، عندما لا تتيسر الوسائل والأدوات الأخرى، ويقوم العرف بذلك الدور من خلال قدراته الهائلة على تفسير النصوص، وبيان المقصود بها، ويعول عليه في التعرف على مقاصد الناس ونياتهم، كما أنه يعتبر دليلاً يستعان به في تكميل تلك الإرادة وتتميمها، وليست وظيفة العرف مقتصرة على ذلك، بل إنها لتمتد إلى جميع جوانب الحياة وميادينها، ولا يمكن لقاضٍ أو مفتٍ أن يستغني عنه، هذا فضلاً عن تجاهله والتعامي عنه.
Abstract
The Custom plays an important role in the Public and Private fields, especially in financial matters. It is considered as one of the important methods and tools which help to sort out disputes and conflicts between people when other methods are not available. This important role played by Custom, depends on the interpretations of the texts and the text leads to. The Scholars depend on customs to find out people's intentions and their aims. Custom, therefore, is taken as a proof and evidence for determining the willingness and the intentions of people. Finally, it is believed that the role played by Custom is extended to all fields of life and, therefore, it is essential for all Judges and Scholars to have a good understanding of this role.
