Abstract

ملخص تتكون العملية الاجتهادية من مرحلتين هامتين لا تنفك إحداهما عن الأخرى، ولا تكتمل إحداهما دون الأخرى، ألا وهما الاجتهاد الاستنباطي والاجتهاد التطبيقي، وتعالج هذه الدراسة الاجتهاد التطبيقي أو التنزيلي من حيث المعايير التي لا بد للمجتهد التطبيقي منها عند نظره في المسألة محل الحكم وواقعها، والظروف المحتفة بها وما أحاط بها من قرائن وتوابع تؤثر في حكم هذه المسألة، ومن حيث الضوابط التي تضبط عملية الفهم للواقعة وواقعها ثم تنزيل الحكم على تلك الواقعة. وقد خلصت الدراسة إلى أن هناك نوعين من المعايير التي لا بد من رعايتها عند النظر في الوقائع وتنزيل الأحكام عليها؛ ألا وهي المعايير الموضوعية والمعايير الشخصية، وقد رصدت الدراسة هذه المصطلحات ببيان المراد منها وأنواعها. ولبّ هذه الدراسة وروحها هو أن فهم الواقعة المراد تنزيل الحكم الشرعي وتطبيقه عليها لا بد أن يكون وفق مقاصد الشارع وغاياته من التشريع وبما لا يؤدي إلى نتائج تناقض مقاصد الشارع من التشريع. وقد أكدت الدراسة في أكثر من محل في ثناياها أن ما يحدث هنا من اختلاف في الحكم ليس تبديلاً ولا تغييراً ولا نسخاً للأحكام الشرعية، وإنما هو تغير مناط الأحكام ومتعلقاتها ومثل هذا لا يعد تغييراً.
