ملخص
يتناول هذا البحث القاعدة الأصولية: "القِرَانُ في النظم يوجب القِرَانَ في الحكم وتطبيقاتها في الفقه الإسلامي وقانون الأحوال الشَّخصية الأردني"، ويهدف إلى بيان معنى القاعدة ومدى أخذ علماء الفقه والأصول بهذه القاعدة والضوابط التي ينبغي توافرها لإعمال القاعدة، وأهم تطبيقاتها الفقهية والقانونية، ومستثنيات هذه القاعدة.
ومن خلال هذه الدراسة تمَّ التعريف بهذه القاعدة، والضوابط العامة التي يجب توافرها لإعمال هذه القاعدة، وكيفية تطبيقها فقهاً وقانوناً.
وقد توصلت الدراسة إلى أنَّ علماء الأصول قد اختلفوا في إعمال هذه القاعدة لكن يمكن تطبيقها وفق الضوابط والشروط التي وضعوها لإعمال هذه القاعدة.
كما أوصت الدراسة بدراسة هذه القاعدة في كل موضوع من موضوعات الفقه من عبادات، ومعاملات، وأحوال شخصية، وعقوبات، وغيرها؛ لوضع الضوابط الخاصة لها، لأنَّ لكل موضوع فقهي ضوابطه التي تخصه في بابه مما يتعلق بالأحكام المتعلقة بهذه القاعدة.
Abstract
This research investigates the rule: Combination in words order obligates combination in legal verdicts and its applications in Islamic Jurisprudence and Jordanian personal status Law
It aims to explain the meaning of this rule, show to which extent scholars used it and what controls are needed to apply it, its legal and juristic applications, and its exceptions.
The study introduces a definition of the rule, its general controls, and ways for applying it.
The research reached the conclusion that scholars differ about applying this rule, however, under the controls and conditions it would be applicable.
The study suggests the recommendation that this rule should be studied in terms of the juristic theme to which it is applied, worship, interactions, personal status issues, penalties, etc. This is because each one of these subjects has its own conditions related to legal ruling about the rule in question.
