ملخص
إن موضوع الحاجة يعتبر من الموضوعات المهمة الحرية بالدراسة، نظرا لارتباط الحاجة بأحد المقاصد التشريعية الثلاثة، وهو المصالح الحاجية، التي تشكل جزءاً مهما في البناء المقاصدي للشريعة خصوصا، وفي منظومتها التشريعية على جهة العموم.
وتهدف هذه الدراسة إلى بيان مفهوم الحاجة في معناها العام، ومدى ارتباط هذا المفهوم العام لها بالمفهوم الخاص في مسائل الزكاة، نظرا لما تمثله الحاجة من أهمية بالغة في مسائل الزكاة، كما تهدف هذه الدراسة إلى إبراز الضوابط المؤثرة في الحاجة والضابطة لمسائلها بالإضافة إلى تتبع المعايير المؤثرة في تقدير الحاجة في الزكاة، وصولا إلى الخاتمة التي تضمنت النتائج والتوصيات التي خلصت إليها هذه الدراسة.
Abstract
This study aims to show the needs concept generally. And revealing its, controls and effects.
Also the study aims to show its on Al – Zakah through monitoring the influencing standards in its consideration and evaluating them.
Since the need has the great effect on the Zakah issues generally, and on the influencing standards in evaluating them specifically.
This study also aims to show the standards influencing the needs evaluation, because these standards have effect on determining the need, and the priorities.
In addition to linking the need at its levels related to Zakat, with the need in its general concept, as part of the international structure of the Islamic law, since the needs interests is one of the third axis of the intenational structure in the Islamic law.
