ملخص
تتناول الدراسة قضية تجديد الفقه الإسلامي المعاصر بأبعاده المختلفة بكونه أداة مهمة من أدوات العصر لتوسيع دائرة النصوص الشرعية من الكتاب والسنة، وإحياء العمل بهما على الأسس الشرعية التي عمل بها النبي والصحابة الكرام بما يحقق أصالة النصوص الشرعية، وبما يعمل بمضامينها وفق المقاصد الشرعية لها، وبما يحقق المناسبة لطبيعة الزمان والمكان، والأعراف الجديدة، والمستجدات المتسارعة، والتطور الهائل في أدوات العصر، تنمية للملكة الفقهية لدى الفقهاء.
Abstract
This research deals with the issue of the renewal of contemporary Islamic jurisprudence with its different dimensions of being an important tool of the era tools to expand religious texts circle from the Qu'ran and Sunnah, and the revival of working with them on the legitimate grounds that the work of the Prophet - peace be upon him - and his companions - God bless them - in order to achieve the authenticity of the texts legitimacy, and what works with the content of those measures in accordance to the legitimate purposes, and in order to achieve appropriate to the nature of time and space, and the new customs, and the rapid developments, the massive development in the era tools, development of talent jurisprudence to the jurists.
