ملخص
تعد الصلاحيات التي تعطى للمحكم في حدود مهمته التحكيمية مثار جدل عند الفقهاء، فبالقدر الذي تنظم فيه إرادة الأطراف شؤون إدارة العملية التحكيمية، فإنها كذلك قد تكون سبيلاً في صياغة سلطة المحكم وأثرها على وقائع الدعوى المستجدة.
وتظهر مزية السلطة المختصة للمحكم في المسائل الوقتية والتحفظية، وفي قبول البينات وردها، أو البت في أحكام اختصاصه، والتي وإن تطلبت المساعدة القضائية في بعض الحالات، إلا أنها تجعل مزية عمل المحكم أكثر من مجرد الإثبات أو إظهار الحكم، وقد جاء هذا البحث ليبين حدود سلطة الهيئة التحكيمية ومدى الصلاحيات التي أنيطت بها في عملية التحكيم بما يخدم التطور الذي وصلت إليه الإجراءات الحديثة.
Abstract
The privileges which are granted to the arbitrator within the boundaries of his arbitration task are considered from the point of view of jurisprudents to be controversial. Although to a certain degree, the incentives of the dispute party organize the procedural management of the arbitration process, they also play a role in defining the authority of the arbitrator and the impact on the resolutions of the emerging case.
The advantage of the authority granted to the arbitrator is salient in interim and conservatory matters, in acceptance and refutation of facts, and in settling provisions of specialization. Even though such matters may call for the assistance of the court in some instances, they give more significance to the advantageous position of the arbitrator which surpasses the mere duty of proving or clarifying the verdict.This Research has been come to demonstrate the limits of the Arbitral tribunal authority and the extent of the powers vested in the arbitration process in order to serve the development which has reached the modern procedures.
