ملخص
يتناول هذا البحث مسألة مهمة وهي: (التحكيم الشرعي أصوله وضوابطه)، وقد تم تقسيم هذا البحث إلى مقدمة وثلاثة مباحث: بحث الباحث في المبحث الأول: تعريف التحكيم ومشروعيته وأهميته، وبحث في المبحث الثاني: أصول التحكيم، وبحث في المبحث الثالث: التحكيم بين المسلمين في بلاد الغرب، ذكر فيه أقوال الفقهاء وأدلتهم، ومناقشة الأدلة والترجيح بين الأقوال.
وقد توصل الباحث إلى أنه يشترط في المحكم الذي يقوم بعمل التحكيم في البلاد الغربية، أن يكون عالماً بالأحكام الشرعية، وعلى دراية بقوانين وعرف البلد التي يعيش فيها، وأنه يجوز أخذ الأجرة على التحكيم، ويكون دفع الأجرة على المتخاصمين، لضمان تنفيذ التحكيم وعدم الإخلال به.
Abstract
This research discusses very important issue in Fiqh, namely: (Legal arbitration Its essentials and standards), it has been divided into , introduction, three subjects, and conclusion: The first subject: defining the concept of Arbitration, its legitimacy and importance, The second subjects: The principles or bases of the arbitration, and the third subject discussed: Arbitration between Muslims in the West, mention the opinion of the scholars, their evidence, and discuss the evidence and weighting between their opinions.
The researcher reached to conclusion that it is require for the arbitrator who works as arbitrator in the western countries, to be aware of the Islamic law, and familiar with the laws and custom of the country in which he lives, and it is permissible to take fees for the arbitration, and the payment will be on the two disputing parties, to ensure the implementation of the arbitration and not to breach it.
