Abstract This research highlights an important juristic issue (delegation of divorce) to the wife and addresses the judiciary problem of the legitimate Jordanian courts of appeal on the issue of the legal impact of the use of the wife the right to divorce or as well known in the Islamic courts as "a wife to take hand in divorce" or the type of divorce resulting from the use of delegated divorce, whether this reaction is retroactive as seen by Irbed court of appeal? or Irreversible as seen by Amman court of appeal? This research deals with tow sections which show some of the provisions relating to the issue of the mandate or delegation, The first one deals with many aspects of mandate in terms of Islamic jurisprudence as a mandate to divorce, its legitimacy, the difference between it and the power of attorney, the formula, the validity, and the rule of irreversible. The second deals with applications for judicial authorization of divorce, the mechanism used by women, the impact on the use of the wife the right to mandate divorce, and when immunity of divorce considered as a mandate or as a condition like other conditions in the contract. Tue, 17 Nov 2009 00:00:00 GMT http://hdl.handle.net/123456789/2439 2009-11-17T00:00:00Z http://hdl.handle.net/123456789/2438 Title: المبهمات في القرآن الكريم Authors: حسن, سامي عطا Abstract: تتناول هذه الدراسة المبهمات في كتاب الله ، والمبهم : هو ما يصعب على الحاسة إدراكه إن كان محسوساً، وعلى الفهم إن كان معقولا والمبهم من الكلام هو الغامض الذي لا يتحدد المقصود منه والمبهم من الظروف هو ما ليس له حدود ،تحصره، مثل ،فوق، وتحت، وأمام، وخلف. والمبهم في كتاب الله : هو كل ما لم يبين في القرآن من اسم، أو عدد، أو مكان، أو نحو ذلك. ومع أن الله سبحانه أنزل كتابه تبياناً لكل شيء، وهُدَىَ لكل خير، إلا أنه سبحانه أبهم بعض الأمور في القرآن لأسباب، فقد يبهم القرآن شيئاً في موضع، ويبينه في موضع آخر، أو يبهمه للستر عليه، أو لتعظيمه، أو لتحقيره ولا يجوز البحث في مبهمات استأثر الله بعلمها، فيجب التوقف عندها، وعدم الخوض فيها فكان هذا البحث لإلقاء الضوء على المبهمات في كتاب الله، فذكرت أنواعها وأسباب وقوعها، وبعض المؤلفات فيها، وبينت فوائد معرفتها، من خلال أمثلة تطبيقية تدل على ذلك، والكمال لله وحده. Abstract The subject of this study vague in the holy Qur'an, Vague: some things which has difficulty to perceive by senses, if it was sensed, and to understand, if it was reasonable. Vague text: the text which has ambiguous meaning Unlimited text. Vague adverb: the adverb which can not be limited or the adverb which does not have bounds, for example, up, down, behind and if front of. Vague text in the holy Qur'an: the text which does not explain in the holy. Qur'an, however, it is name, number or place and so on. Although God sent his book Holy Qur'an to explain all the sections of life and right guidance of good, God did not detail some text for certain reasons for example to hide certain object. Some Qur'an texts may be vague in a specific position and detailed in another position to aggrandizing and degrading. Working to explain the vague texts are prohibited because God save it's sciences for himself. Finally, I write this research about vague texts in the holy Qur'an, therefore, I mention its kinds and its references, and why it occurs, and benefits of knowing it though applied examples.
