http://hdl.handle.net/123456789/1086 Sat, 13 Jun 2026 09:20:23 GMT 2026-06-13T09:20:23Z http://hdl.handle.net/123456789/1106 Title: التحديات التربوية الــتي تواجه أبناء الأقليات المسلمة في إنجلترا * Authors: د. نادر صدقي الرفاعي Abstract: ملخص هدفت هذه الدراسة إلى سبر الواقع التربوي للجالية المسلمة في إنجلترا، وبيان التحديات التي يواجهها الجيل المسلم الناشئ في الغرب، وكيفية تعامل الجالية المسلمة في الغرب مع هذه التحديات على المستوى الفردي والجماعي. استخدمت الدراسة المنهج الوصفي التحليلي لدراسة الظاهرة وتحليلها في سياقها الاجتماعي من خلال جمع وتحليل معظم ما كتب حول الظاهرة موضع الدراسة. وقد أظهرت الدراسة أن هناك مجموعة من التحديات التربوية المهمة التي تواجه أبناء الأقليات المسلمة في بريطانيا، منها ما يتعلق بطبيعة وتكوين النظام المدرسي، ومنها ما يتعلق بموضوعات المنهج الوطني والمحتوى التعليمي، ومنها ما هو عام على مستوى الجالية. كما أظهرت الدراسة أن الأقلية المسلمة استطاعت تذليل كثير من هذه العقبات بينما لا تزال أخرى قائمة تؤرق الجالية. كلمات مفتاحية: الأقلية المسلمة، الجالية المسلمة، التحديات التربوية، انجلترا. Abstract The study aimed at examining the educational reality of the Muslim minority in England; exploring the main challenges facing the new Muslim generation born and brought up in the west; and demonstrating the ways in which Muslim communities have dealt with these challenges individually and collectively. The study used the analytical descriptive method to study the phenomena in its real social context through collecting and analyzing most of what has been written about the phenomena under question. The study revealed a number of significant challenges facing the children of the Muslim minorities in England. Some of these are related to the nature of the British schooling system; others are related to the National Curriculum (NC) subjects and their learning content; while other challenges are general and related to the entire community. The study also revealed that the Muslim minority has defeated many of these challenges while the rest still exist and irritate the community. Tue, 21 Feb 2017 00:00:00 GMT http://hdl.handle.net/123456789/1106 2017-02-21T00:00:00Z http://hdl.handle.net/123456789/1105 Title: الحقوق الزوجية الــتي لا تقبل الإسقاط - دراسة فقهية مقارنة- * "** Authors: د. محمد سليم "محمد علي; د. عـروة عكرمـة صبــري Abstract: ملخص تناول البحث دراسة الحقوق الزوجية التي لا تقبل الإسقاط، وهي الحقوق التي لم تثبت بعد لعدم وجود سببها، والحقوق المعتبرة شرعًا في الأوصاف الذاتية الملازمة للشخص، والحقوق التي يترتب على إسقاطها تغيير للأحكام الشرعية، والحقوق التي تتعلق بحق الغير. حيث تم استعراض هذه الحقوق مفصلة من خلال دراسة الفروع الفقهية المتعلقة بالحقوق الزوجية، مع بيان موقف قانون الأحوال الشخصية الأردني منها. فكان من هذه الحقوق التي لا تقبل الإسقاط والمتعلقة بعقد الزواج وآثاره حق الأب والجد في ولاية النكاح وكذلك حقهما في الكفاءة، وحق المرأة في تسمية المهر في عقد الزواج،، وكذلك حق الزوجة في النفقة فلا يصح إسقاطه عن الفترة المستقبلية، وحق الزوجة في الجماع والاستمتاع والإنجاب، وحقها في المبيت والقسم والمسكن المستقل عن ضرائرها عند تعدد الزوجات. ومن هذه الحقوق التي لا تقبل الإسقاط بعد الطلاق والفرقة الزوجية، حق الزوجة في المطالبة في فيئة الزوج من إيلائه، وحقها في اللعان بعد ثبوته، وحقها في المطالبة بالتفريق للعنة والعجز الجنسي كما يثبت للزوج حق الرجعة في الطلاق الرجعي فلا يصح إسقاطه، كما لا يصح إسقاط الحق في سكنى المعتدة ولا نفقة العدة المستقبلية. وكذلك لا يصح إسقاط حق الصغير في النسب، كما لا يصح إسقاط حق الأم في الحضانة إن تعينت الحضانة عليها. Abstract This research discusses the couple rights that can’t be overthrown; the rights that don’t be proved yet, also the accredited legitimate rights in self-descriptions that are accompanying to the person and the rights that are related to other rights. I browse these rights in details by studying juristic branches that related to couple rights with stating the situation of Jordanian law of personal conditions. From these rights that can’t be overthrown; the rights that related to marriage-contract and their effects. For example the father’s and the grandfather’s right in “ALWELAYA”, also the woman’s right in mentioning her dower in marriage-contract, her right in future expense and her right in coition, whelping, sleeping and independent dwell. Also the research discusses the rights that result after divorce and dispersal; like the wife’s right after “ALELA”, her right in dispersing because of aphanisis and disability to copulate, also her right to return in revocable divorce and finally her rights in “ALEDDA”. Also pewee’s right in affiliation and the mother’s right in nurturing can’t be overthrown. Abstract Human mind has been engaged since old times in seeking ways of the best methodology of engaging, understanding and knowing intentions of Texts. Hermeneutics is considered one of the old deep-rooted methods that was used for that, its influence has reached Contemporary Arab Thought in its dealings with Religious Texts and has met quite large popularity in many contemporary schools of thought. In this Study there is an explanation of its reality and essence in Western Thought -where it originated-, its roots -which belong in Greek Thought and Jewish and Christian Religions- and stages of development and foundations of each stage. All of this explains that this is an alien way of thought and a western human approach not fit to be applied in human texts let alone in divine texts. The Study includes an Introduction that has a statement of the importance of the subject, cause of adopting it, the study plan and three sections: the first section is to elucidate Hermeneutics and its connotation, the second on its roots and the third one is an explanation of its development, stages and its outcomes.
