Title: الحيلولة وأثرها في الزكاة "دراسـة تأصيليـة تطبيقيـة" Authors: محمد محمود الطوالبة Abstract: ملخص تناولت الدراسة مسألة منع المالك من التصرف أو الانتفاع في ملكه، الأمر الذي قد يكون سببا في ضعف الملك، وفوت النماء، وهو ما يعرف بالحيلولة؛ وأثره في الزكاة، وأمثلته التطبيقية. وبينت معنى الحيلولة، وما في معناها، وعلاقتها بشروط الزكاة، وأثرها في الزكاة حال كونها مؤثرة في النماء، أو غير مؤثرة. وتوصلت إلى تعريف وشروط وأقسام مبتكرة للحيلولة، وأنها تؤدي إلى سقوط الزكاة عن زمن الحيلولة، وإذا عاد المال إلى صاحبه استأنف به حولا جديدا؛ رعاية لجانب أرباب الأموال، واستنادا إلى الإخلال بحرية التصرف، ونقص المنفعة، المؤدي إلى خلل في نماء المال، الذي راعاه الشرع في تحديد مقدار الزكاة. وتمكنت من استخلاص شروط وجوب الزكاة عن زمن الحيلولة عند القائلين به من الفقهاء. كلمات مفتاحية: الحيلولة، النماء، الملك الناقص، سقوط الزكاة. It showed the meaning of impersonation, and what is in its meaning, pictures, and sections, and its relationship to the conditions of zakat, and its effect on zakat if it is affecting growth, or not affecting. It reached a definition, conditions and innovative sections for the foreclosure, and that it leads to the fall of zakat from the time of the foreclosure. Islamic law determining the amount of Zakat. Title: العود الجرمي في الفقه الجنائي الإسلامي: أسبابه وآثاره "دراسة مقارنة مع الفقه الجنائي الوضعي" Authors: عماد محمد التميمي Abstract: ملخص تمثّل ظاهرة العود الجرمي, عبئاً ثقيلاً يواجه المختصين في مجال مكافحة الجريمة. وبرغم الجهود التي تبذل في هذا المجال والمتمثلة في الندوات والمؤتمرات والبرامج التي تهدف إلى معالجة المجرم، ومكافحة الجريمة قبل دخول المجرم السجن وأثناء وجوده فيه وبعد خروجه منه، إلا أن الأمر ما زال يؤرّق الباحثين بسبب الإحصائيات التي تؤكد وجود هذه الظاهرة الخطيرة وزيادتها. وللحد من تنامي حالات العود، ينبغي الوقوف على الأسباب الحقيقية المرتبطة بالجريمة والتركيز على آليات التعاطي معها والمقاربات الكفيلة بمعالجتها. ولقد جاءت هذه الدراسة لتسهم في تسليط الضوء على منهج الشريعة الإسلامية في معالجة هذه الظاهرة مع مقارنة ذلك بالقانون الوضعي. الكلمات المفتاحية: العود الجرمي، التكرار الجرمي، تغليظ العقوبة. Criminal recidivism in Islamic criminal jurisprudence, its causes and effects -A comparative study with civil law- Abstract The crime of recidivism is a heavy burden that confronts crime specialists. Despite the efforts made in this field, which are represented in seminars, conferences and programs aimed at treating the criminal and combating crime before the criminal entered and while he was in prison, but the matter continues to haunt researchers because of the statistics that confirm the existence of this dangerous phenomenon and its increase. To limit the growth of cases of recidivism, one should examine the real causes associated with the crime and focus on the mechanisms of dealing with it and the approaches to address it. This study has come to shed light on the approach of Islamic law in dealing with this phenomenon with a comparison with that of civil law.
