الملخص

تصحيح التصرفات: هو بذل الجهد والوسع في حماية تصرف صادر عن مكلف من الفساد والبطلان بوسيلة معتبرة شرعاً، إذا كان ذلك ممكناً. والتصحيح هنا يشمل كل الصور التي يصان فيها التصرف عن الإلغاء والبطلان، فيشمل تجزؤ البطلان، وتحول العقد، وإجازة العقد الموقوف، وتصحيح العقد الفاسد عند الحنفية. وإذا كان من الواجب شرعاً صيانة تصرفات المكلف العاقل عن اللغو والإبطال، فقد اجتهد الفقهاء في محاولة تصحيح التصرف الصادر عن المكلف ما أمكن، وقد اعتمد الفقهاء على وسائل كثيرة في ذلك، كـان للقواعد الفقهية دور كبير وأثر بارز في هذا المجال، فكان هذا البحث محاولة لجمع هذه القواعد الفقهية التي اعتمد عليها الفقهاء في تصحيح التصرفات وحمايتها من البطلان، حيث تم تصنيف القواعد حسب دورها في عملية التصحيح إلى نوعين: القواعد المتعلقة بالألفاظ، والقواعد غير المتعلقة بالألفاظ.

Abstract

Correction of actions is an effort made to protect an act of the mature person from corruption, invalidity means legally, if possible. Correction includes all methods, which preserve the act of revocation and invalidity, includes the partial nullity, the transformation of the contract, , and correct the corrupt contract according to the H. If it is the responsibility of Sharia preserve mature the actions of person from null and corruption , so the scholars of jurisprudene work hard to correct the actions as much as possible, by adopting many way. The rules of jurisprudence have played very important roles and have a significant impact on this area. This research is an attempt collect to such rules adopted by the jurisprudence scholars to correct the actions and to protect it from corruption. The rules were classified according to their role in the corrections process into two types: the rules related to words, and rules related to no words.
