الملخص
شكَّلت الاتفاقيات الدولية المرجعية الأساسية في إنفاذ حقوق الملكية الأدبية والفنية. غدا فيها نظام الإدارة الجماعية واحدا من الأدوات التي تسهم في تحقيق القدرة على الاستئثار الأمثل بالحقوق المالية لأصحاب تلك الحقوق في أي من مجالات العلوم، والآداب، والفنون. وفي الوقت الذي عد واجبا فيه على جميع الدول الأعضاء في اتفاقية التربس العمل بهذا النظام، فإن عددا من التشريعات الوطنية - بما فيها المشرع الأردني- تجاهل النص عليه ضمن قوانين حماية حق المؤلف، فضلا عن عدم تبنيه لأية هيكلة تتولى إدارة تلك الحقوق. الأمر الذي أفضى إلى نتائج سلبية على الحقوق المالية والأدبية للمؤلفين وأصحاب الحقوق المجاورة من جهة، وعلى جدية هذه التشريعات، وتلك الأنظمة في وفائها لالتزاماتها الدولية من جهة أخرى.
Abstract
International Agreements have been the essential reference in implementing the artistic and literary property rights. Group management has been one of the tools which enables anthors to utilize and exercise their rights in any creative work. As an obligation of the member states that adopt the TRIPS agreement to implement this system, some national legislation including the Jordanian legislation, has nol only ignored this clause to be included in the copyright law but also it did not adopt any other mechanism for implimenting such rights. As a result of not adopting any mechanism that could manage these rights, this has lead to serious negative results upon literary and financial rights of authors and the owners of relating rights in one hand, and on the seriousness of these legislations and those mechanisms in implimenting the international obligations of the agreement on the other hand.
