الاجتهاد القضائي في فقه الامام الشافعي رحمه الله

Abstract

  یتناول البحث موضوعا متخصصا یبین منزلة الإمام الشافعي - رحمه الله- في التشریع القضائي الإسلامي، والذي یظهر بجلاء من خلال اجتهاداته الفقهیة في أبواب القضاء المختلفة في كتبه المتعددة. وقد رأى الباحث أن یتناول هذا المجال من مجالات العلوم الكثیرة التي برع فیها الإمام الشافعي لعدم وجود دراسات متخصصة في هذا السیاق فیما اطلعت علیه من كتابات حول الإمام الشافعي - رحمه الله- ، ویعد المجال القضائي من أكثر المجالات الشرعیة المأخوذ بها في الواقع المعاصر و بخاصة في الدول العربیة والإسلامیة. وقد تناول الباحث آفاقا مخصوصة من الاجتهاد القضائي عند الإمام الشافعي - رحمه الله- وقدم الباحث نماذج تبین حقیقة الاجتهاد القضائي عند الإمام الشافعي - رحمه الله- وهذه المجالات هي: أولا : الاجتهاد القضائي للإمام الشافعي - رحمه الله- في أدب القضاء والقاضي وأصول التقاضي. ثانیا : الاجتهاد القضائي للإمام الشافعي - رحمه الله- في الدعاوى ووسائل الإثبات. . ها  ثالثا : الاجتهاد القضائي للإمام الشافعي - رحمه الله- في الأحكام القضائیة وتنفیذ Abstract This specialized topic reveals the prominent position of Imam Al- Shafi'i in the area of the Islamic judicial legislation. This high position is evident from his innovations dispersed throughout various judicial sections in his works. The researcher picked this field from many other fields where Imam Al- Shafi'i has excelled, because of the lacking of specialized studies thereof to the best of the researchers knowledge. The researcher discussed certain aspects of the Imam’s innovations, and presented some samples which unveil the nature of his innovations. These aspects are: 1) Al- Shafi'I innovations in the manners of the judge and the judicial system and the principles of prosecutions. 2) Al- Shafi'I innovations in proceeding and substantiation 3) Al- Shafi'I innovations in the judicial ruling and the execution.
