Title: مدى جواز التأمين الصحي من الحوادث القضائية فقهاً وقانوناً

Abstract: الملخص تعمد المؤسسات العامة في الدولة لتوفير خدمة التأمين الصحي للعاملين فيها ولذويهم، وفقاً لأنظمتها الخاصة، لما في ذلك من انعكاسات إيجابية على عمل الموظف في ظروف آمنة وطبيعية. بيد أن هذه الخدمة لا تتوفر دائما لهؤلاء إذ إن العديد من أنظمة التأمين الصحي تستبعد الحالات الناجمة عن الحوادث القضائية من التأمين الصحي مما يجعل تأمينها غير جائز قانوناً ويترتب على ذلك حالة من الحرج والضيق ترافق إصابة المستفيد من التأمين الصحي بحادث قضائي بسبب عدم تغطية نفقات علاجه وبخاصة عندما لا يتسنى له ذلك لظروفه المالية الصعبة. ويعتبر الحادث قضائياً متى وقع بفعل من الغير وترتب عليه أضرار معينة أعطت الحق للمضرور اللجوء إلى القضاء للمطالبة بالتعويض عما أصابه. ويختلف الفقه الإسلامي في الأساس الذي يبني عليه جواز التأمين الصحي ففي الوقت الذي يبنى في أنظمة التأمين الصحي على مجال هذا التأمين فيكون جائزا قانوناً في مجال دون آخر كما هو الحال في مجال التأمين من الحوادث القضائية فإن الفقه الإسلامي يعتمد في إجازته من التأمين الصحي على الصورة التي تم بها، فإذا كان تعاونياً عد التأمين الصحي جائزاً شرعاً ولا فرق بعد ذلك بين مسببات الحالة الصحية مرضية أم غير مرضية، أما إذا كان تجارياً عُد التأمين الصحي غير جائز شرعا سواء بالنسبة للحالة المرضية أم لغيرها. ولعل في توحيد أنظمة التأمين الصحي في الدولة والمؤسسات العامة من حيث جعل الحوادث القضائية مشمولة بالتأمين الصحي ما يؤدي إلى تحقيق المساواة بين المستفيدين من أنظمة التأمين الصحي مهما كان السبب الذي أدى إلى حاجتهم إلى المعالجة. Abstract Due to medical expenses in the untimely event that the one may be injured or become ill, health insurance is the right way to keep him apart from unexpected circumstances with no ignore the unable accelerating of the medical expenses with the time. For that public institutions have there own legal systems to organize, health insurance for their officials. Most legal systems govern that institutions exclude judicial accidents form coverage of health insurance; this may embarrass the beneficiary especially if he wasnt able to afford medical expenses. On the other hand Islamic jurisprudence doesnt classify the causes of illness for purposes of insurance the criteria to consider health insurance legitimate is not based on the scope of insurance but on the type of insurance and legitimate requirements. There for heath insurance is legitimate whether from judicial accidents or from another if it was cooperative and is not legitimate if it was commercial. Thus, I suggest by the end of this research to have one rule in order to unify all medical health insurance regulations of public institutions, to keep judicial accidents under the umbrella of health insurance.
