تفردات الصحابي عبد الله بن مسعود في ميراث الجد مع الإخوة والأخوات الأشقاء ولأب: دراسة فقهية قانونية

Abstract

ملخص يهدف البحث إلى دراسة المسائل الإرثية التي تفرد فيها الصحابي الجليل عبد الله بن مسعود  والتي تتعلق بميراث الجد مع الإخوة والأخوات الأشقاء ولأب، ومعرفة مدى عمل القوانين العربية بها. ولهذا السبب تم الحديث عن ثلاث مسائل: الأولى في حال اجتماع الجد والأخوات الشقيقات مع الإخوة لأب، والثانية في حال اجتماع الجد والإخوة مع الأم، والثالثة في مسألة: بنت، وأخت، وجد. وانتهى البحث إلى عدة نتائج وتوصيات، ومن أهم النتائج تعدد الروايات عن عبد الله بن مسعود، ولكن ترجيحها يسهل بعد الرجوع إلى قواعده التي اختارها في طريقة التشريك بين الجد والإخوة، ومن أهم التوصيات أهمية اعتماد تشريع موحد للمسلمين في مسائل الجد مع الإخوة. الكلمات الدالة: الفقه الإسلامي – القضاء - الميراث – الجد مع الإخوة والأخوات الأشقاء ولأب- الصحابي عبد الله بن مسعود. Uniqueness of the companion Abdullah bin Masoud In the inheritance of the grandfather with brothers and sisters, brothers and father: legal jurisprudence study Abstract The research aims to detail the doctrine of the great companion Abdullah bin Masoud - may God be pleased him - with regard to the issue of the inheritance of the grandfather with brothers, sisters, who are siblings and a father, to appear in the end, the extent of the arabic law's work, according to the opinions of Abdullah bin Masoud. For this reason, three issues were discussed: the first in the case of the grandfather and the sisters sharing with the paternal brothers, the second in the event of the grandfather and the type of brothers sharing with the mother, and the third in the issue of: a daughter, a sister, and a grandfather. The research concluded with several results and recommendations, and one of the most important results is the multiplicity of narrations about Abdullah bin Masoud, but its weighting is easy after referring to his rules that he chose in the method of socialization between grandfather and brothers, and one of the most important recommendations is the importance of adopting a unified legislation for Muslims in matters of grandfather with brothers.
