تهريب الآثار: مفهومه وحكمه وسبل الحد منه - دراسة فقهية قانونية مقارنة-

Abstract

ملخص تهدف هذه الدراسة إلى بيان الموقف الفقهي والقانوني من تهريب الآثار من حيث المفهوم والحكم الشرعي وسبل الحد منه، وقد اتبعت الدراسة المنهج الوصفي؛ بوصف الظاهرة كما هي في الواقع، ثم استقراء الحكم الفقهي لها وسبل الحد منها من خلال تحليل النصوص الشرعية مع مقارنتها ببعض القوانين العربية. وقد انتهت الدراسة إلى أن تهريب الآثار فعل محرم شرعاً ومجرم قانوناً؛ استناداً إلى مجموعة مؤيدات شرعية؛ هي كون التهريب فيه اعتداء على المال العام، فضلاً عن مخالفته لولي الأمر إضافة إلى الضرر المترتب عليه. أما تدابير الحد من هذه الظاهرة؛ فهي وقائية وعلاجية؛ ومن الوقائية: ضبط الفتوى فيما يتعلق بالآثار، وتفعيل دور المجتمع المحلي في الحد من تهريب الآثار عن طريق منح مكافأة مجزية لمن يقدم معلومات إلى الأجهزة المختصة تفضي إلى منع تهريب الآثار. أما العلاجية فظهرت في تشريع عقوبات رادعة لمن يقترف هذا الفعل. الكلمات المفتاحية: تهريب، آثار، فقه، قانون. Antiquities smuggling: its concept, rule, and ways to reduce it- Comparative legal jurisprudence study Abstract This study aims to clarify the juristic and law position on the smuggling of antiquities in terms of the concept and the legal ruling and the ways to reduce it. The study followed the descriptive approach by describing the phenomenon as it is in reality, then extrapolating the juristic judgment to it and ways to reduce it through the analysis of legal texts. Comes to conclusion that smuggling antiquities is a forbidden act according to Sharia law, based on a set of legitimate supporters, namely that smuggling is an assault on public money. As for measures to reduce this phenomenon, they are preventive and curative. Preventive: controlling the fatwa regarding antiquities, and activating the role of the local community in curbing antiquities smuggling. As for treatment, it appeared in the legislation of deterrent penalties for those who committed this act. Key words: Smuggling, Antiquities, Jurisprudence, Law.
