ملخص
يهدف هذه البحث إلى دراسة موضوع التعويض المادي عن الضرر الأدبي (دراسة فقهية مقارنة)، وقد جاء البحث في مطلبين، وخاتمة، بينت في المطلب الأول: مصطلحات الدراسة (التعويض، الضرر، المادي، الأدبي)، وبينت في المطلب الثاني: حكم التعويض المادي عن الضرر المعنوي، وقد خلصت الدراسة إلى القول بجواز أخذ العوض المادي عن الضرر المعنوي، ويعود تقديره للقاضي، فلا يجوز أن يحول ذلك دون اقتضاء الشخص لحقه، خصوصاً أن القصد من تعويض الضرر الأدبي ليس إزالة الضرر، وإنما ترضية المتضرر ومواساته، في حين ذهب بعض الفقهاء إلى القول بعدم جواز أخذ العوض المادي عن الضرر المعنوي؛ بدعوى أنه غير قابل للضبط والتقدير، وأن تعويضه يتعارض مع مكارم الأخلاق ومحاسن العادات، وإنما يجب فيه التعزير، وهو موكول لرأي ولي الأمر كما وكيفا، وفي الخاتمة: بينت أهم النتائج والتوصيات التي توصلت لها الدراسة.

Abstract
