ملخص
أثبتت الشريعة الإسلامية للحيوان جملة من الحقوق التي تحقق المقاصد الشرعية من خلقه وإيجاده، وتحدد علاقة الإنسان به انتفاعاً واستغلالاً، وهذه الحقوق هي الحق في الحياة والحق في الغذاء والحق في منع الألم والحق في المحافظة على نوعه، وبينت الدراسة أن هذه الحقوق لا يجوز المساس بها وإهدارها إلا لمصلحة معتبرة شرعاً، كما بينت أن هذه الحقوق ليس مجرد توجيهات خلقية وإرشادات اختيارية، وإنما هي حقوق محمية بجملة من الضمانات التي تكفلها وتمنع انتهاكها والاعتداء عليها، وقد اشتمل هذا البحث على مشروع قانون ينظم حقوق الحيوان ويحدد كيفية التعامل معه.
Abstract
Islamic Shar’iah demonstrated that there are a number of animal rights that achieve the legitimate purposes of his creation, and demonstrate the relationship of the human with the animal and how to utilize it. These rights are the tight of life, food, the right of preventing pain, and the right of keeping. And maintaining it.
This study showed that these rights should not be prejudice. These rights are not just a moral rights or optional, but right are protected by rulls in order to prevent the abuse of these rights.
This research has been included on the draft law regulating the rights of animals in Islam, and how to deal with it.
