الملخص

تعد نماذج الفقهاء وبرديات الدولة المالية وثائق تاريخية هامة تفيد في دراسة المعاملات المالية ذات الصلة بالمنافع الجارية ‏بين الأفراد، حيث تقدم الوثائق البردية من جهتها قدراً من المعلومات حول الأنشطة أو الممارسات الاقتصادية المتنوعة، كذلك ‏تتضمن عقوداً خاصة بالإجارة، سواء المتعلقة بإجارة الأرض أو العقارات أو القوارب، إضافة إلى إشارتها لعقود العمل وما يترتب ‏عليها من أجرة .‏ ‏ ويمكن متابعة الملامح الرئيسة لعقود البرديات من خلال عقد مقارنة دقيقة ومباشرة مع ما يتوفر من صيغ الإجارة أو اركانها ‏الواردة لدى الفقهاء، متزامنة أيضا مع الشواهد العملية للإجارة الواردة في المصادر التاريخية، للوصول بعد هذه الموائمة لنتيجة ‏مهمة وهي مدى التجانس والتطابق بين المفاهيم النظرية والإجراءات التطبيقية للإجارة في الحضارة الإسلامية.‏ الكلمات الدالة: عقـود البرديات، صيغ الفقهـاء، الإجـارة‎.‎ Abstract ‏ ‏The jurists' forms and the State's financial Papyri are considered to be important historical documents; that ‎are beneficial in the examination of financial transactions related to contracts of mutual interests between individuals. ‎ Papyri documents include information about diverse financial transactions such as lease contracts relating to ‎land, or real estates, or boats. They also include information about work contracts that are inclusive of service ‎charges. ‎ The basic features of the papyri contracts could be detected through a meticulous and explicit comparative ‎examination of the lease forms available with jurists, along with practical implications of lease existent in historical ‎resources. This, in its turn, leads to a significant conclusion pertaining to the extent of cohesiveness and ‎compatibility between theoretical concepts and the practical applications of lease in the Islamic civilization. ‎ Keywords: Papyri Contracts, Jurists' Forms, Lease. ‎
