Abstract

ملخص

يكشف هذا البحث اللثام عن أسلوب الامتنان في الخطاب الشرعي وأثره في القواعد الأصولية والأحكام الشرعية، فعمد الباحث إلى دراسة بعض القواعد الأصولية التي قامت بناء على هذا الأسلوب من خطابات الشارع، وقد وجد الباحث أن أساليب الشارع متنوعة في الدلالة على الأحكام الشرعية، وليست مقتصرة على خطاب التكليف الذي هو إما طلب فعل أو طلب ترك ، أو تخيير بين الفعل والترك، ووجد الباحث أن لأسلوب الامتنان أثراً كبيراً أيضاً في الأحكام الشرعية، تبينها الباحث من خلال بعض المسائل التطبيقية كأثر لهذا الأسلوب في عدد من الأحكام الفقهية المتنوعة، التي كانت محل اختلاف بين العلماء في النظر إليها.

Abstract

This study unveils issues pertaining to the style of gratitude-triggering discourse and its impact on fundamental rules and jurisprudence rulings. The researcher deliberately examined some fundamental rules based on such divinely style. He has found that various divinely styles have been used to stipulate jurisprudence rulings; and they are not necessarily confined to superimposing discourse which is mainly realized in three forms of obligation, prohibition or an option between the two. The researcher has found that gratitude-triggering style has too great impact on jurisprudence rulings as deduced through examining a number of applied issues of relevance to various jurisprudence rulings of controversy among scholars.
