Abstract: الملخص هدفت هذه الدراسة إلى إلقاء الضوء على الحق في السكن اللائق في الدستور الأردني، ‏انطلاقاً من أهمية القاعدة الدستورية في تعزيز وحماية حق الإنسان بما فيها الحق في السكن اللائق ‏الذي يوفر الأمن والطمأنينة للإنسان ويساهم بشكل رئيس في المحافظة على كرامته، وللوقوف على ‏مدى كفاية تنظيم الدستور الأردني لهذا الحق فقد تمت مقارنة أحكامه مع ما ورد في في مبادئ ‏الشريعة الإسلامية والمعايير الدولية لحقوق الإنسان. وقد خلصت الدراسة إلى أن الدستور قد أغفل ‏النص بشكل صريح وواضح على حق الإنسان بالسكن اللائق ولم يبين طبيعة واجب الدولة بتوفير ‏السكن اللائق للأفراد، كما لم يتطرق لمضمون السكن اللائق. وبناءً على ما توصلت إليه الدراسة فقد ‏تم اقتراح مجموعة من التوصيات لموائمة التشريعات الوطنية مع مبادئ الشريعة الإسلامية ‏والمعايير الدولية لحقوق الإنسان‎ ‎كان في مقدمتها تعديل الدستور الأردني والنص صراحة على الحق ‏في السكن اللائق. ‏ الكلمات الـــدالة: الحماية الدستورية، حقوق الإنسان، الحق في السكن اللائق.‏ Abstract This study aimed at shedding the light on the right to adequate housing in the ‎Jordanian constitution. We compared its stipulations with other modern constitutions and ‎with the principles stipulated in the Islamic Sharia as well as with international human ‎rights standards. ‎ In the Jordanian Constitution there is no mention of the right to adequate housing ‎and it did not show the role that the state should play in providing people with such ‎housing. ‎ Based on the study, a number of recommendations was proposed in order to ‎make national legislation comply with the Islamic Sharia and international human rights ‎standards; for most is the amendment of the Jordanian constitution to explicitly address ‎the right to housing. ‎ Key words: constitutional protection, human rights, the right to housing‏.‏
